> Hunter B. Emerick
Hunter Emerick focuses his practice on business litigation and related issues. He concentrates on issues involving construction law and litigation; real property disputes, including condemnation; disputes over the ownership and operation of corporation, LLCs, and partnerships; disputes arising from the purchase and sale of businesses and other complex litigation. Mr. Emerick is licensed to practice in both Oregon and Washington.
Business Litigation
Mr. Emerick has represented clients in many different business disputes in both state and federal courts, as well as administrative tribunals, including:
- Representing a farmer in a complex breach of warranty suit against a supplier whose product destroyed the client's entire crop
- Defending a newly formed company against a competitor and former employer in a suit for unfair competition and breach of nondisclosure and noncompetition agreements
- Representing timber owners in a breach of contract and timber trespass claim against a major timber products company.
- Defending many employers against BOLI and state court claims for injured worker discrimination.
- Representing property owners in actions to obtain contribution for environmental contamination
- Representing farmers against agricultural service company and applicator for crop damage. Representing land owners in condemnation actions brought by governmental authorities.
- Defending shareholders and partners in litigation for breach of fiduciary duty and dissolution
- Representing developers in condemnation action against local governments
- representing purchasers of contaminated property in recovering costs of clean up activities
- Defending equipment manufacturers against claims by purchasers on warranties and for disclosure of confidential information
Construction Law
Mr. Emerick assists developers, contractors, and subcontractors in neogtiation and drafting various agreements concerning development and construction. He provides advice and guidence to construction clients on issues concerning contract performance; insurance coverage; lien rights and remedies; and constuction defects. Mr. Emerick has served as an Associate Member of the Board of Directors for the Home Builders Association of Marion and Polk Counties. He recently was elected as Associate Vice President for that organization. He has presented several construction related seminars for members of the HBA. He has also represented contractors in construction disputes, including:
- Defending general contractors against breach of contract claims by homeowners
- Defending engineers against negligence claims by homeowners
- Defending material suppliers against environmental claims brought by DEQ
- Defending subcontractors against prevailing wage claims brought by BOLI Representing contractors in breach of contract claims against other contractors
Commercial / Residential Leases
Mr. Emerick has appeared in courts throughout the state representing landlords. He successfully prosecuted a three day jury trial evicting a dangerous tenant defended by the Multnomah County Legal Aid Service which was affirmed by the Oregon appellate courts. Mr. Emerick has represented various commercial landlords, including large malls in evicting commercial tenants.
Professional Activities
Mr. Emerick is a member of the Litigation and Construction sections of the Oregon State Bar. He is admitted to state and federal courts in Oregon. He is also admitted to Washington State Courts. He is a past President of the Marion County Bar Association. He has received an AV rating in Martindale from his colleagues.
Education
Mr. Emerick graduated cum laude from Willamette University in 1979. He graduated cum laude from the Willamette University School of Law in 1982 and served for two years as the senior clerk for Chief Justice of the Nevada Supreme Court.
